1. Who these terms apply to
These Terms of Service ("Terms") are an agreement between the clinic or dental practice that creates an Enamela account ("Clinic", "you") and [Company legal name] ("Enamela", "we"), the operator of the Enamela platform at enamela.app, app.enamela.app, and book.enamela.app. By creating an account, or by using Enamela on behalf of a clinic, you agree to these Terms.
If you are an individual accepting these Terms on behalf of a clinic, you confirm that you have the authority to bind that clinic. These Terms do not apply to patients booking appointments, whose relationship is with the clinic; see the Patient Privacy Notice for how patient data is handled.
2. The service
Enamela is dental clinic management software: scheduling, patient records, an odontogram and treatment charting, billing, staff roles, and a patient-facing booking page. Enamela is provided as a hosted, multi-clinic service; each clinic's data is logically separated from other clinics on the platform.
We may add, change, or remove features over time. We will try to give reasonable notice of changes that materially reduce functionality you rely on, but we do not guarantee that every feature will remain available indefinitely.
3. Accounts and roles
You are responsible for the accuracy of information used to set up your account, and for the accounts and role permissions your clinic administrators grant to staff (for example front desk, dentist, or admin roles). Each staff member should have their own login; do not share credentials.
You are responsible for the actions taken under your clinic's accounts, including any actions taken by staff you have granted access to. Notify us promptly if you believe an account has been compromised.
4. Free trial
New clinics get a 7-day free trial with no card required. At the end of the trial, you choose a paid plan to keep using Enamela; there is no automatic charge because no payment method is collected during the trial. If you do not choose a plan, access to the account may be limited or paused after the trial ends.
5. Plans, billing, and payment
Paid plans are billed monthly or yearly, in advance, at the price shown at checkout for your selected plan and billing cycle. Prices may change with notice before your next renewal.
- Monthly plans renew automatically each month until cancelled.
- Yearly plans renew automatically each year until cancelled and may offer a discount versus monthly billing.
- Payment is processed by third-party payment processors; see the Subprocessors page. Enamela does not store your full card details.
- Failed or overdue payments may result in a grace period followed by suspension of access, as described in your plan.
See the Refund and Cancellation Policy for cancellation, downgrade, and refund terms.
6. Acceptable use
You agree to use Enamela only for lawful dental clinic management purposes, and not to misuse the platform, its messaging features (including WhatsApp appointment messages), or its data. Full rules are in the Acceptable Use Policy, which is part of these Terms.
You are responsible for obtaining any consent required by law from your patients before using Enamela's features to store their data or message them.
7. Your data and content
You (the Clinic) own the clinic and patient data you put into Enamela. For patient data, you act as the data controller and Enamela acts as the data processor, as described in the Data Processing Agreement.
You grant Enamela a limited license to host, process, and display your data solely to provide and support the service to you, and to maintain backups and audit logs as described in the Security page.
8. Intellectual property
Enamela and its software, design, odontogram assets, and branding are owned by [Company legal name] or its licensors. These Terms do not transfer any ownership of the platform to you. You retain ownership of your clinic and patient data as described above.
9. Support and availability
We aim to keep Enamela available and to respond to support requests in a reasonable time, but we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated where practical. Our support team may access your clinic account only with your consent, and such access is logged, as described on the Security page.
10. Disclaimers and liability
Enamela is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Enamela is a practice management tool and does not provide clinical, medical, or dental advice; clinical decisions remain the responsibility of the treating clinician.
To the extent permitted by law, our total liability arising from these Terms or your use of Enamela is limited to the amount you paid us for the service in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under [governing law - to be decided with counsel].
11. Termination
You may cancel your subscription at any time from your account settings; cancellation takes effect as described in the Refund and Cancellation Policy. We may suspend or terminate an account for material breach of these Terms, non-payment, or misuse of the platform, with notice where reasonably possible.
On termination, we will make your clinic data available for export for a reasonable period as described in the Data Processing Agreement, after which it may be deleted in line with our retention practices.
12. Changes to these terms
We may update these Terms from time to time. We will post the updated version with a new "updated" date, and for material changes we will make reasonable efforts to notify clinic administrators. Continued use of Enamela after changes take effect means you accept the updated Terms.
13. Governing law and contact
These Terms are governed by [governing law - to be decided with counsel].
Questions about these Terms can be sent to legal@enamela.app [confirm address].
